Oregon Court of Appeals denies permit for Oregon LNG pipeline

Clatsop County last year denied the permit to Oregon Pipeline Company to construct a 41-mile segment of a natural gas pipeline on the ground of bias. 

The natural gas pipeline is a part of a larger LNG project that involves multiple facilities in multiple jurisdictions.

After an appeal to the Oregon Land Use Board of Appeals, Oregon LNG had the county’s decision overturned as LUBA found evidence that one of the county’s commissioners was biased, as a State of Oregon Court of Appeals statement reveals.

The Court of Appeals did however unanimously reverse the LUBA decision, rejecting claims of bias which in turn confirmed the county’s vote to reject the Oregon LNG pipeline.

It was concluded that the Oregon LNG proposed pipeline violated Clatsop County’s land use rules on numerous grounds.
