At the Offshore Energy Conference at the Amsterdam Rai on 28 October 2014 the Dutch Offshore Academy and its partners will be presenting the following Workshops.

Workshop – The Importance of Compliance with International Anti Bribery Laws

Paying bribes, “facilitation” payments or so called “consultancy fees” to win contracts or to facilitate project execution is a criminal offence in many jurisdictions that is penalised with jail sentences and large fines. The UK Bribery Act 2010 and other international legislation have now made anti-bribery an issue of ever increasing importance for contractors in the North Sea. Many contractors do not seem to be aware of the potential impact of involvement with bribery accusations. It is really is not good PR for an operator or contractor to become the subject of a highly publicised corruption or anti bribery case. Understanding the risks of bribery and corruption and putting proper anti-bribery management systems in place is of the utmost importance for contractor and operators alike.

Lonneke Hollierbroek will give an overview of important anti-bribery legislation and will discuss what contractors and operators can do to protect themselves.

Workshop – Bimco Time Charter Supplytime 2005 Tips and Tricks

The Supplytime 2005 is probably the most widely used charter party in the offshore industry. Without a doubt, the Supplytime 2005 is weighted in favour of Owners and if something goes wrong, Charterers can be caught out with costly consequences.

In his presentation, Tom Adams of Stephenson Harwood will discuss some of the most important aspects of the Supplytime 2005 that Owners and Charterers need to be aware of.

Workshop – Liabilities, Indemnities and Insurances in the Offshore Industry – A perfect fit or is there room for improvement?

The usual system of contracting in the offshore industry is based on the knock for knock liability and indemnity system. This system is supported by a complex system of insurances such as H&M, P&I, property insurance, workmen compensation / employer’s liability, general liability and construction all risk insurances.

The insurance broker Nico de Wit (Intramar) and the lawyer Nigel Margetson (Margetson Van ‘t Zelfde & Co) will discuss the interrelationship between the various liabilities, indemnities and insurances, whereby the question will be raised if the existing insurance policies offer full cover or if some risks remain uninsured, regardless of an extensive insurance package.

Workshop – Disputes in the Offshore Construction Industry: A Case study

Claims and disputes in offshore construction projects are commonplace, but often complex in nature. An independent professional can provide valuable early assistance to ensure adequate records are kept, notifications are sent, evidence (including witness statements) is collected and mitigating measures are taken. In a later stage of the dispute, an independent professional can provide the relevant technical review of the background of your dispute, provide high level technical comments and can prepare a formal expert report to support your cause.

Remko Luyten (Offshore Independents) is an experienced expert witness. In his workshop Remko will discuss a case that the Offshore Independents were involved in. The case study is intended to make the role of an expert witness in an offshore dispute clear.
